As we all know, President Trump has announced that he will end the Deferred Action for Child Arrivals (commonly known as “DACA”) program in six-months. He has told Congress that he wants them to enact and send him legislation that will address the immigration status of those currently in the DACA program. If Congress does decide to act, this will give them an opportunity to address the immigration issues of both the DACA recipients, their parents and others similarly situated. more

Our client is a native and citizen of the Philippines. He was brought to the U.S. before his 16th birthday and was a candidate for DACA due to this education, lack of criminal history, etc. There has much discussion about DACA in recent months, including President Trump recently announcing that the program would be rescinded. Regardless of President Trump’s decision though, because of our client’s timely request for DACA and the submission of necessary forms and supporting documents, he has been granted DACA until 2019. more

Our client is a Chinese national who has filed an application for adjustment of status with the USCIS. She is attempting to obtain her green card based on an approved EB-5 petition. However, our client has a need to potentially travel back to her native China. She understands that leaving the U.S. while her Form I-485 is pending will cause her application to be deemed ‘abandoned’ unless she obtains authorization from the Department of Homeland Security. We therefore submitted the necessary documents and fees, and with this approval, our client is now free to temporarily return to China for personal or business reasons. more

By : | Category : Recent Approvals | Comments Off on Approval of Provisional Unlawful Presence Waiver (Form I-601A) – September 6, 2017

Our client is a native and citizen of the Philippines. She entered the U.S. with a K-1 Fiancé(e) Visa but was unable to ever be granted her green card based on marriage to her K-1 petitioner. She ultimately met and fell in love with her current U.S. citizen husband, but was ineligible for adjustment of status due to her prior entry with a K-1 Fiancé(e) Visa. Hence, the need for a Provisional Unlawful Presence Waiver to avoid having a 10-year bar after she departed the U.S. for her Immigrant Visa interview at the U.S. Embassy in the Philippines. We are proud to say that our client’s request for her waiver was approved after we were able to show that her husband would suffer ‘extreme hardship’ if our client was not issued her green card. more
