Michael Bhotiwihok is a senior associate attorney with the firm. For more than a decade he has represented clients and successfully handled countless cases across the country in Immigration Courts, at United States Citizenship and Immigration Services (“CIS”) offices nationwide, and at U.S. Embassies around the world.
Michael’s Immigration Court experience comes from defending clients from deportation with cases involving Asylum, Cancellation of Removal, and various waivers (“212(c), 212(h), and 237(a)(1)(H)”) for grounds of inadmissibility. For clients arrested and detained by Immigration and Customs Enforcement (“ICE”), he has won bond custody redetermination hearings and their freedom from detention. Michael works effectively with the Office of the Chief Counsel in achieving grants of Prosecutorial Discretion and in Reopening Cases previously closed before the Immigration Courts.
Outside the courtroom, Michael represents individuals before CIS for their green card interviews. He has in depth experience with the Removal of Conditions on Residency and obtained permanent 10 year green cards for clients. Michael represents clients for EB-1 visas for Aliens of Extraordinary Ability in gaining their green cards in the United States. He also represents clients in obtaining their dream of U.S. Citizenship at Naturalization interviews before CIS.
For clients in need of humanitarian assistance, Michael has successfully obtained relief for his clients under the Violence Against Women Act (“VAWA”), Temporary Protected Status (“TPS”), U-Visas for victims of crime, and Deferred Action for Childhood Arrivals (“DACA”). In cases involving the death of a petitioner, he represents clients in their 204(l) adjustment of status and humanitarian reinstatement requests. Michael represents clients for their Provisional Waiver for Unlawful Presence which allows families to stay together during the waiver’s adjudication.
At U.S. Embassies Michael represents clients in the consular processing of Non-Immigrant Visas (“NIV”) and Immigrant Visas (“IV”) such as K visas for fiancés and spouses of U.S. Citizens and family based immigrant visa petitions through U.S. Citizens or green card holders. His NIV experience includes B visas for tourists and medical emergencies, O visas for temporary workers of extraordinary ability, P visas for entertainers, and Q visas for cultural exchange visitors. Michael’s IV representation includes the filing of an immigrant visa petition with CIS, National Visa Center (“NVC”) processing, and consular processing with U.S. Embassies around the world.
In the employment based realm, Michael represents individuals, small businesses, and multi-national corporations with visas for temporary workers including H visas for temporary workers (“H-1B, H2-A, H-3, H-4”). Additionally, he represents employers before the Department of Labor (“DOL”) with permanent labor certifications (“PERM”) and Immigrant Petitions for Alien Workers (“I-140”) before CIS. Michael centers his employment based representation on the fashion, arts, entertainment, and technology industries.
Michael has achieved positive results for numerous clients in appeals before the Board of Immigration Appeals (“BIA”) and the Administrative Appeals Office (“AAO”).
Getting To Know Michael
As the son of immigrants from Australia and Thailand, Michael understands the difficult challenges presented to non-citizens by the United States immigration system. He genuinely cares about each and every one of his clients and has a reputation as an advocate for immigrants’ rights.
Michael graduated from the University of North Carolina at Chapel Hill with a Bachelor of Arts in Political Science in 1997. He earned his Juris Doctorate along with an International Law Concentration certificate in 2001 from Nova Southeastern University in Fort Lauderdale, Florida.
Michael is admitted to the Florida Bar, United States District Court, Southern District of Florida, and is authorized to practice immigration law throughout the United States.
